Unknown Hinson Fan :I have studied the tax code to a fairly extensive degree. I have worked in estate planning for over a decade. I am a member of the State Bar of Georgia. I do not, in any way, shape or form, see how anyone can read Title 26 and come to the conclusion that exchanging one type of currency for another is any type of capital gain. Do you get to claim a capital gain or loss when you exchange dollars for Canadian dollars when making a trip to Canada? No. More importantly, do you get to claim a capital loss every year due to the Federal Reserve printing more money (inflating)? If you have money saved whether it be in a bank or in cash form, that "money" loses value every second. You do not get to claim that as a capital loss. Currency is not capital.
Stingray...Unknown Hinson Fan is correct...the IRS created a tax treatment for gain on foreign financial assets in Nov 2011; the forms were updated Nov 2012. Simply exchanging one currency for another is not subject to capital gain tax. The IRS instructions and forms go over many scenarios for holding the foreign assets and the threshold level where the individual or entity holding the asset(s) reports to the IRS they are holding the asset even before an increase in the value of the foreign asset. Page 4 of the instructions recognizes foreign currency as a foreign financial asset....the 2012 instructions go more in depth and addresses holding these assets in IRAs even...read and get some good advice from a CPA and/or a tax attorney....Peace....
Unknown Hinson Fan :I don't see how it is taxable under Title 26 (Internal Revenue Code). This is my honest opinion based on my knowledge. I am not trying to be controversial or start any conflict. There may be something coming down the pipe from the feds that changes my opinion.
